Terms of Service

These terms cover the photography galleries, images, and licenses provided by The TO Agency. By accessing a gallery or purchasing a license, you agree to them. The TO Agency is operated by IGY6 Company LLC, a woman-owned and veteran-owned business based in Florida.

Not affiliated with the U.S. government
The TO Agency is a private, commercial business. We are not affiliated with, endorsed by, or sponsored by the U.S. Department of Defense, any branch of the U.S. Armed Forces, or any federal agency. Our work with military-connected clients and communities does not imply federal endorsement.

Ownership
The TO Agency owns the copyright to all images we produce, including images captured by photographers working on our behalf. Purchasing a license grants you specified rights to use the images. It does not transfer ownership.

Gallery access
Galleries are password-protected and provided for the client and their designated team. Access may require an email address and a download PIN. Do not share credentials outside your organization. Galleries may be archived or removed after a reasonable period, so download what you need while access is active.

Watermarked images
Watermarked, web-size images are provided at no cost. You may share them on social media, on your website, and in internal materials, with credit to The TO Agency and the photographer. You may not crop, edit, obscure, or remove the watermark, and you may not use watermarked images in paid advertising, printed collateral, or any material where the watermark has been altered or hidden.

Licensed images
Clean, full-resolution images are available under license. Current tiers and terms are published at thetoagency.co/work/licensing. All licenses are non-exclusive and non-transferable, and each license covers the use of one organization. A license does not permit you to give, sell, or sublicense the images to another business, vendor, partner, or affiliate. If a second organization needs use of the images, a second license is required.

Permitted and prohibited use
Licensed images may be used for your marketing, website, social media, print, and promotional materials. You may not resell the images, license them to others, submit them to stock libraries, or claim authorship. Reasonable cropping and color adjustment for layout is fine. Materially altering an image, including compositing or AI manipulation, requires written permission.

Our use of the images
The TO Agency retains the right to use images we produce in our portfolio, on our website, in social media, in marketing materials, and in submissions for publication or industry recognition. If a specific image needs to stay private, tell us in writing before the shoot and we will note it.

Payment and delivery
Licenses are purchased through our gallery platform and processed by a third-party payment processor. Full-resolution files release the same business day payment clears. Because these are digital goods delivered immediately, license purchases are final and non-refundable.

Photography services
Bookings, rates, deliverables, and turnaround for photography services are set out in a separate agreement. Nothing in these terms creates an obligation to provide services.

Disclaimers
Galleries and images are provided on an as-available basis. We are not liable for indirect or consequential damages. Our total liability for any claim is limited to the amount you paid for the license in question.

Changes
We may update these terms. Changes are posted here with an updated date, and licenses already purchased are governed by the terms in effect at the time of purchase.

Governing law
These terms are governed by the laws of the State of Florida.
